Question of the Day – COBRA Subsidy Ending September 30, 2021

Q: The COBRA subsidy is ending on September 30, 2021. What do I need to provide to Assistance Eligible Individuals (AEIs) enrolled in COBRA?

A: Employers or the COBRA administrators need to provide AEIs with a notice of expiration of premium assistance. The notice must be written in clear concise language and inform the AEI if they may be eligible for coverage without premium assistance through regular COBRA coverage.

The Department of Labor (DOL) has provided a Model Notice of Expiration of Premium Assistance in word and pdf format. The model notice can be found on the DOL website page COBRA Premium Subsidy for Employers and Advisers. This notice must be provided during the 45-15-day period before the AEI’s subsidy ends and should be sent no later than September 15, 2021 to any AEI that has the subsidy through September 30, 2021.
