Q:What happens if an employee is out on workers’ compensation during the coronavirus shutdown?

A: Workers’ compensation benefits will continue to be paid to the employee.

Q: What if an injured employee was released to full duty however; due to the coronavirus shutdown the office, plant, warehouse, etc., is closed and no work is available?

A: If post 90 days from the date of the injury the Worker’s Compensation carrier could reach out to the injured worker to see if he/she would be willing to sign a supplemental agreement wherein the employee acknowledges they are able to return to work however, no work is available because of the coronavirus shut down. Claimant further agrees to withdraw his work comp benefits and will file for unemployment if he or she chooses to do so. Logical next question; why would the employee agree to withdraw his WC claim if benefits would continue? Due to the recent Federal Government stimulus, specifically as it relates to unemployment compensation, persons could receive more in unemployment compensation then they would on workers’ compensation. 

Q: If I receive a PPP loan and bring back my furloughed employees, do I still pay workers’ compensation premium on their wages?

A: Yes, even if they remain at home, the employees payroll would still be included at audit. If the employees were injured while at home during working hours there is a strong likelihood the injury would be compensated.
