Q: Recently, a Pittsburgh based grocery store chain was sued under the Americans with Disabilities Act for its mask-wearing policy. Is there insurance coverage available to protect me from this type of lawsuit?

The short answer is yes. Coverages vary from insurer to insurer but most would provide this coverage on an Employment Practices Liability (EPLI) policy with Third Party Liability Coverage.  A Third Party means any person who is a customer, vendor, service provider or other business invitee of the insured. The policy provides coverage for discrimination against a Third Party for acts such as race, color, religion, creed genetic information, age, sex, disability, marital status, natural origin, pregnancy, HIV status and sexual orientation.  The policy also provides coverage for sexual harassment against a Third Party.
