Documentation Required for Paid Leave

The Department of Labor (D.O.L) and the Internal Revenue Service have issued guidance on documentation employers must request and retain for each of the paid leaves under Families First Coronavirus Act (FFCRA). The documentation for both the Emergency Paid Sick Leave and Expanded Family Medical Leave are the same but should be documented separately.

If an employee requires Paid Sick Leave and or Expanded Family Medical Leave, employers will need the following documentation from an employee:

  • Employee name
  • Date or dates the leave is requested
  • Qualifying reasons for leave
  • Statement that the employee is unable to work, including telework for that specific reason and written support for such reason
